Legislation relevant to agri-food and international trade often originate from the European Union, directly via regulations or directives that are implemented in domestic legislation. ABLD advises companies on how to comply with these rules. We engage with authorities on behalf of our clients and litigate where appropriate.

EUDR / Deforestation Regulation

The Deforestation Regulation of 2023 requires companies to ensure that products sold in the EU do not contribute to deforestation and forest degradation. Additionally, it mandates a reduction in carbon emissions associated with the consumption and production of these products. This regulation applies to timber, cocoa, soy, palm oil, coffee, rubber, and cattle, as well as to products derived from them, such as leather, chocolate, and furniture. ABLD advises and assists importers and exporters in complying with the Deforestation Regulation.

CSDDD / Corporate Sustainability Due Diligence Directive

The Corporate Sustainability Due Diligence Directive mandates that companies conduct due diligence regarding human rights and environmental impacts. Companies must assess the extent of any negative effects on human rights and the environment within their supply chains and take appropriate measures to mitigate these impacts. This directive will impact not only large companies but also small and medium-sized enterprises, as well as suppliers outside of Europe. For example, suppliers of fresh fruits, nuts, and flowers from South America, Africa, and Asia will be affected. ABLD supports businesses and their suppliers in understanding the implications of this directive and in its implementation.

GDPR / Privacy

The General Data Protection Regulation (GDPR) requires companies to handle the personal data of EU citizens carefully and lawfully. Under the GDPR, companies must obtain consent for storing and processing personal data, create and publish a clear privacy policy, and report any data breaches to the Dutch Data Protection Authority promptly. ABLD assists companies in meeting their obligations under the GDPR.
